Probate

Probate regulates the winding-up of the financial affairs of a person who has died without a valid trust.  It includes those with a valid will (considered 'testate'), those with no will (considered 'intestate') and those with an invalid trust.  Although the process is subject to many procedural rules, it basically revolves around 3 goals: to identify and collect all assets of the decedent, to settle all claims and debts, and then to distribute the remaining assets according to the decedent's will (if testate) or according to California's law of intestacy (if intestate).
